Back again

Hi,
I am back again. It has been a long time (Feburary 2006 and now it is December 2007) but here I am! Just thought I would let everyone know. I have had alot of health problems and so has my wife. On top of that, My brother/sister (transexual) passed away in Augusta, Ga and I live in centeral Alabama. I was his only living relative and next of kin so I spent most of the time in Augusta taking care of his/her obligations and property that I haven't had time to do anything for myself, but the property is sold now and everything else taken care of so, I am back home.

Welcome back Barbra,

Taking care of someone's estate can be a real chore. I've only had to deal with it minimally and didn't like it at all. The death of a loved one is traumatic enough, but having to deal with the added responsibility to execute a will can be most overwhelming. I'm sorry to hear of your loss. I hope things will start to "normalize". (that is, if you can call our lives "normal" #-o )

Thanks Kyra & Donna T. The part about living in Augusta and taking care of the estate really wasn't all that bad. Augusta has been a part of my life really since I was stationed there at the young age of 18 years old. Loosing my brother/sister was pretty bad since now my parents and my real sister are gone and there is no-one left except my wife, children and grand children for which I thank God everyday.
But really it is good to know that someone cares. Thank you.
Now if I can catch up on a years absent from my home everything will be great. My son took care of my home, mowed the grass and collected the mail for me while I was away so mabey things can get back to normal.

HI Bobbie,

I too am sorry for your loss. I know personally the turmult that can be created when someone dies and they have not taken care to "arrange" things, i.e., a will and other items.

I tell this story because it does have a moral for those who may not have dealt with this before. When my grandmother died (my step-grandfather had predeceased her) I was acting as host in her house as people came by to share there condolences. I happen to glance at her bedroom and the door was partially closed but I could see my grandfather's two "maiden sisters" going through my grandmother's dresser like some kind of police investigation. I walked up behind them, put my arms around their shoulder and not so gently pulled them to me and said, "can I help you ladies?" Somewhat taken back they stammered something about an antique broach (very valuable) that they said that my grandmother had said they could have when she died and they were just looking for it! Well, I just smiled and said, "Well of course and you have that in writing I assume?" "Uh, well, uh no, but ......." was all that Lily could muster. "Well ladies," as I turned and escourted them to the front door. "Your outta here!" as I not so gently showed them the door.

Yes, the broach is in Virginia's possession and I wear it with great pride and my shared name with my grandmother, Irene!

Damn, can't trust anyone! :twisted:

I had no problem with anyone except the authorities since his wife died about 17 years ago and was from Germany. They had no children. I was the only one mentioned in the will. But did you ever have a will probated in the state of Georgia? That took a little over six months. I was able to get control of his bank account but by the time that I did, I owed the Federal Government over $2000.00 for pensions that had been paid after his death. The burial expense was almost $9000.00 and he had no insurance to cover that. In the end I did come out ahead but not by a whole lot. Besides, it cost an arm and leg to live there for almost a year with the expense that I had keeping up my own home.

Hi Barbra,
Hope you have gotten everything straightened out and can now move on with living your life. I certainly realize what dealing with probate in GA is like, wish my fathers estate had been completed in six months. It should have been very simple as my sister had power of attorney years before his death, file the correct documents and boom! done. Instead we are now approaching 5 years with many issues unresolved, the probate court seems to not require documentation for anything, you can simply sit down at a word processor and make up any fairytale you like and submit it to the court. What a frigging joke GA is, course it may not be much better anywhere else. I apologize for my rant, but it touched a very sore nerve in me. God bless and hope all goes well for you.

Hi Bobbie. Sorry to hear you lost your sibling. That can be very trying, let alone all the needed legal matters. Did your sibling complete transition before death? For some of us who transition later in life, that is very important to try to do.

Hi, all -

Okay, time for me to wear my Para Legal hat again!

Stories like what Denise Douglas relate regarding probate court are yet another reason why I always urge that, instead of setting up a simple Last Will & Testament, Durable Power of Attorney, Living Will, and Health Care Advocacy documents . . . .

you just spend the extra money and set up a Revocable Living Trust, which has all those documents and more, make sure all 'titled' possessions are re-named to that of the Living Trust (banks, brokerages, IRA's, house, car, etc.) . . .

and usually, by having a Living Trust, in most states this eliminates the need for Probate Court and attorneys, or just requires a basic notice to Probate Court that a Living Trust is in existence.

Of course, all Wills and Living Trusts can be contested . . . whether they succeed or not depends upon how well the legal documents have been prepared, but most properly prepared Living Trusts withstand contesting.

Oh, and for the record, a DNR (Do Not Resuscitate) form cannot be enforced if EMS (paramedics, EMT's, etc.) are called; the sole reason for EMS to be called is to save a life and as a result they are exempt from DNR's.
